These Terms & Conditions ("Terms") govern your access to and use of the website at laplanteservices.com and any related services (the "Service"), operated by La Plante Services ("we," "us," or "our"), located at 307 Picnic View Ln, Oceanside, CA 92056. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
La Plante Services provides an online marketplace where users can browse property listings, post properties for sale, upload photos and videos, and exchange messages with other users. We provide the platform only; we are not a party to any transaction between buyers and sellers and do not act as a real estate broker, agent, or escrow service unless expressly stated in a separate written agreement.
You must be at least 18 years old and able to form a legally binding contract to use the Service. You are responsible for the accuracy of the information you provide and for all activity that occurs under your submissions.
You are solely responsible for any content you submit, including listings, descriptions, prices, photos, videos, and messages ("User Content"). You represent that you own or have the rights to post your User Content and that it is accurate and not misleading. You grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute your User Content for the purpose of operating and promoting the Service.
You agree not to post content that is unlawful, fraudulent, infringing, discriminatory, or that violates fair housing laws or the rights of others.
We may remove content or suspend access at our discretion if we believe these Terms have been violated.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not verify the accuracy of listings or the identity of users, and we make no representations regarding any property. You are responsible for conducting your own due diligence, inspections, and professional and legal advice before entering into any real estate transaction.
To the fullest extent permitted by law, La Plante Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of the Service or from any transaction between users. Our total liability for any claim relating to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
You agree to indemnify and hold harmless La Plante Services from any claims, damages, or expenses arising out of your User Content, your use of the Service, or your violation of these Terms.
The Service relies on third-party providers, including Google Firebase (data hosting and storage), Stripe (payments), and our web host. Your use of those features may also be subject to those providers' terms.
We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Your continued use of the Service after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute shall be subject to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.
